有关中欧法学院机构设置和人员聘用法规和合约摘录

作为中欧法学院主要行政负责人,中方联席院长有义务向管理委员会提出有关机构内部设置和人事工作的报告。

As the principal administrator, the Chinese co-dean is obliged to report to the JMC on the internal structure and personnel of CESL.

法律依据 (legal basis)

(1) 《中华人民共和国中外合作办学条例》(2003),第26条:

“中外合作办学机构的校长或者主要行政负责人行使下列职权:

……

(三) 聘任和解聘工作人员,实施奖惩;

……”

Regulations of the People’s Republic of China on Chinese-Foreign Cooperation in Running Schools (2003), Article 26:

"The president, or the principal administrator, of a Chinese-foreign cooperatively-run school shall exercise the following powers:

...

(3) Employing and dismissing the staff and executing rewards and punishments;

..."

(2) 《中华人民共和国中外合作办学条例实施办法》(2004), 第23条:

“中外合作办学机构内部的组织机构设置方案由校长或者主要行政负责人提出,报理事会、董事会或者联合管理委员会批准。

Implementation Measures for the Regulations of the People’s Republic of China on Chinese-Foreign Cooperation in Running Schools (2004), Article 23:

"The internal organizational structure of a Chinese-foreign jointly run school shall be put forward by the president or principal administrator to the board of trustees, the board of directors, or the joint managerial committee for approval.”

1. 凡中欧法学院教师和管理人员,都应与中欧法学院签订聘用合同。

All employment contracts shall be signed between CESL and faculty or staff members.

法律依据(Legal Basis)

(1) 《中华人民共和国中外合作办学条例实施办法》(2004 ), 第46条:

“中外合作办学机构和项目教师和管理人员的聘任,应当遵循双方地位平等的原则,由中外合作办学机构和举办中外合作办学项目的中国教育机构与教师和管理人员签订聘任合同,明确规定双方的权利、义务和责任。”

Implementation Measures for the Regulations of the People’s Republic of China on Chinese-Foreign Cooperation in Running Schools (2004), Article 46:

"The employment of teachers and administrative staff by a Chinese-foreign jointly run school and educational programmes shall be based on the principle of equality. Chinese-foreign jointly run schools and the Chinese educational institution that launches the Chinese-foreign jointly run school shall sign employment contracts with the teachers and administrative staff, specifying the rights, obligations, and responsibilities of each party.”

(2) 《外国专家来华工作许可办理规定》(2004),第3条第(2)项、第4条第(5)项:

凡受聘在中国从事教育工作的外国专家,“应取得‘外国专家来华工作许可’”,而申请文件须包含“与聘请单位订立的由国家外国专家局统一印制的标准聘用合同” 。

Regulations on Working License for Foreign Experts in China (2004), Article 3(2) and Article 4(5):

Foreign experts engage in education in China “should apply for License of Foreign Expert Working in China”, and the application document should include “a standard contract printed by State Bureau of Foreign Experts signed between the foreign expert and the hosting unit.”

(3) 《中华人民共和国个人所得税法实施条例》(2011), 第5条:

“下列所得,不论支付地点是否在中国境内,均为来源于中国境内的所得:

(一)因任职、受雇、履约等而在中国境内提供劳务取得的所得;……”

Regulation on the Implementation of the Individual Income Tax Law of the People's Republic of China(2011), Article 5:

"The following categories of income, regardless whether or not payments be made within China, shall be considered income derived from sources within the territory of China:

(1) Income derived from on job, employed or contracted labor service performed within the territory of China; ……”

2. 除非合同有相反规定,聘用合同的义务履行地为北京。

Unless otherwise specified in the contract, the place of performance of the contract shall be Beijing.

凡中欧法学院聘用的外籍教师和管理人员,都应申请Z签证,聘用合同为申请签证的支持文件。

CESL’s foreign faculty and staff members shall apply for Z visas to enter China. The employment contract is one of the supporting documents for the Z visa application.

法律依据(Legal Basis)

(1) 《中华人民共和国中外合作办学条例》(2003), 第29条:

“中外合作办学机构的外籍人员应当遵守外国人在中国就业的有关规定。”

Regulations of the People’s Republic of China on Chinese-Foreign Cooperation in Running Schools (2003), Article 29: "Foreign personnel at a Chinese-foreign cooperative education institution shall observe the relevant provisions on employment of foreigners in China.”

(2) 《中华人民共和国外国人入境出境管理法实施细则》(2010),第4条第(2)项:

“签发普通签证时,根据外国人申请来中国的事由,在签证上标明相应的汉语拼音字母:

……

(二)Z字签证发给来中国任职或者就业的人员及其随行家属;

……”

Detailed Rules for the Implementation of the Law of the People’s Republic of China Governing the Administration of Entry and Exit of Foreigners (2010), Article 4(2):

"According to the stated purpose of a foreigner’s visit to China, ordinary visas shall be marked with certain Chinese phonetic letters:

...

(2) Z visas are for foreigners and their accompanying family members who come to China to take up a post or for employment;

..."

(3) 《中华人民共和国外国人入境出境管理法实施细则》(2010),第6条第(2)项:

“申请Z字签证,须有中国聘雇单位的聘请或者雇用证明,或者被授权单位的函电” 。

Detailed Rules for the Implementation of the Law of the People’s Republic of China Governing the Administration of Entry and Exit of Foreigners (2010), Article 6(2):

"in applying for a Z visa, documents of certification issued by the sponsor or employer in China indicating the engagement or employment, or letter or telegram sent by an authorized organization”

3. 中欧法学院本身不是法人,其权利、义务的最终承担者为中国政法大学,中欧法学院信赖汉堡大学的承诺,将全部资金用于中欧法学院,因此,中欧法学院以自身的名义签订聘用合同是以中国政法大学和汉堡大学授权为基础,该项授权意味着中国政法大学和汉堡大学对受聘人共同负其责任。

As CESL is not a legal entity, CUPL, trusting UHH’s commitment that all the EU funds will be used for CESL, ultimately undertakes all the rights and obligations of CESL. Therefore, the basis on which CESL signs employment contracts is the authorization of both CUPL and UHH, which means CUPL and UHH will be jointly responsible for CESL employees.

汉堡大学通过其提名的联席院长签署聘用合同进行授权,中国政法大学通过其人事处的书面文件进行授权。

Authorization, as mentioned above is made by UHH when a contract is signed with the European Co-Dean nominated by UHH, while CUPL makes a written authorization issued by its Department of Human Resources.

法律依据(Legal Basis):

(1) 《组建中国政法大学中欧法学院的中外合作办学协议》(2008),第4.3条:

“……中欧法学院属政法大学的一部分,其自身并无法人资格。”

Agreement on the Sino-Foreign Jointly Operated School to Establish the Europe-China School of Law, Article 4.3:

"... CESL shall be part of CUPL and will have no legal personality.”

(2) 《组建中国政法大学中欧法学院的中外合作办学协议》(2008),第12.1条:

“经政法大学和汉堡大学共同授权,中欧法学院得以自己的名义与当地员工签定服务合同(包括但不限于劳动合同)。”

Agreement on the Sino-Foreign Jointly Operated School to Establish the Europe-China School of Law, Article 12.1:

"By the joint authorisation of CUPL and UHH, ECSL shall sign the service contracts (including but not limited to labour contracts) with local personnel in its own name.”

4. 除按教学任务聘用的兼职教师和临时工作人员之外,签订一切有固定期限或者无固定期限的聘用合同,都应遵守公开招聘程序。

Except for adjunct professors who are appointed based on the teaching plan and individuals who provide temporary services, all employment contracts, with or without a fixed term, shall be concluded through open recruitment.

在中国政法大学人事处网站、中国政法大学中欧法学院网站或者授权其他网站刊登包含职位、待遇和任期的中、英文招聘信息。

Job advertisements shall be published, in Chinese and English, on the website of the CUPL Department of Human Resources, the CESL website or other websites with CESL’s authorization. The advertisements shall contain details of the position, remuneration and contract term.

招聘信息应在相关网站首页的显目之处保留至少90天。

Advertisements shall remain on the home page for at least 90 days.

法律依据(Legal Basis):

《北京市事业单位公开招聘工作人员实施办法》(2010),第6条:

“事业单位招聘工作人员应面向社会公开进行,凡符合报名条件的各类人员均可报名应聘。”

Implementation Measures on Open Recruitment for Positions at Public Institutions (2010), Article 6:

"All recruitment must be open. All qualified applicants may enroll.”

5. 中欧法学院作出有关聘用、薪酬、晋升和解聘的决定,应当将性别、种族、国籍、年龄和宗教排除在考量因素之外。

In making decisions on employment, salary, promotion or dismissal, CESL shall exclude all factors unrelated to competence and performance, including but not limited to gender, race, nationality, age and religion.

在中欧法学院内部,职位相同,待遇亦相同。

CESL follows the rule of equal work, equal pay.

法律依据(Legal Basis):

(1) 《中华人民共和国劳动法》(1994),第12条:

“劳动者就业,不因民族、种族、性别、宗教信仰不同而受歧视。”

Labor Law of the People’s Republic of China (1994), Article 12:

“Employees shall not be discriminated against due to their nationality, race, sex, or religion.”

(2) 《中华人民共和国劳动法》(1994),第46条:

“工资分配应当遵循按劳分配原则,实行同工同酬。……”

Labor Law of the People’s Republic of China (1994), Article 46:

"Distribution of wages shall be based on work allocated following the principle of equal pay for equal work. ...”
